The Kasese Grade I Magistrate’s Court sitting today at Rukoki has acquitted and dismissed charges of stealing a child from MorianMbambu which had been levied against her.
Court presided over by the Kasese Grade I Magistrate, His Worship FashialMbaleNgamije heard that on April 05, 2025 while in Kidodo Cell of the Central Division in Kasese Municipality, Mbambu allegedly stole Kismat Mumbere, aged one and half years belonging to Geofred Bwambale and Jalia Muhindo.
When Mbambu was arrested and arraigned before court to take plea on the matter, she denied the charges, forcing court to take her to Mubuku Government Prison for now close to 10 months.
Today afternoon, upon assessing the evidence of 5 witnesses, -court decided to acquit the charges levied against Mbambu and set her free on grounds that State failed to bring sufficient evidence to prove that the accused person stole the child and fraudulentlydetained the child.
Court also held that by the time the incident happened, police would have established the whereabouts of the allegedly stolen child.
Speaking to Messiah Radio shortly after the court session, Counsel Denize Atholere Mbambu, a Defense Lawyer working with Uganda Christian Lawyers’ Fraternity,said her client was acquitted because all the witnesses failed to bring exhibits before court and neither did, they testify seeing her carrying the victim on the fateful day.
However, Mr. Bashir Bwambale, a relative to the victim who also doubles as the area L.C I Secretary they were not satisfied with the judgement and threatened to appeal to a higher court.
